How Many Hours Is Full-Time in the U.S.?

Full-time is not one universal number of hours under U.S. federal wage law. The Fair Labor Standards Act (FLSA) does not define full-time or part-time employment; an employer generally sets its schedule and classification. Other rules use their own thresholds: for the Affordable Care Act’s employer shared responsibility provisions, the IRS generally treats an employee as full-time for a calendar month at an average of at least 30 hours of service per week or 130 hours per month. The federal overtime rule for covered, nonexempt workers generally starts after 40 hours worked in a fixed workweek. These answer different questions.

Is full-time 30, 35 or 40 hours a week?

The numbers refer to different decisions. 30 hours is the IRS weekly average used with a 130-hour monthly equivalent in a particular ACA employer health coverage framework. 35 hours is the BLS cutoff for its usual-hours survey classification. 40 hours worked is the federal weekly overtime threshold for covered, nonexempt workers. None of these numbers alone sets every employer’s full-time schedule.

How to calculate a full-time schedule from clock times

Subtract only breaks that are genuinely unpaid from each shift, then add the time worked in the employer’s defined seven-day workweek. The table below uses illustrative five-day schedules; it does not declare which schedule any employer must offer.

Short rest breaks are generally counted as hours worked under federal guidance. A bona fide meal period can generally be excluded when the employee is completely relieved from duty. How many annual hours does a full-time schedule represent?

The common 2,080-hour figure is arithmetic: 40 scheduled hours × 52 weeks. A 37.5-hour schedule × 52 weeks is 1,950 scheduled hours. These are planning estimates, not a federal definition of full-time and not necessarily hours actually worked. Time off, holidays, changes in schedule and unpaid absences alter actual work hours. Paid leave may be included in annual paid hours while not being hours worked for the federal overtime calculation.

For a rough monthly planning average, 40 × 52 ÷ 12 is about 173.33 scheduled hours; 37.5 × 52 ÷ 12 is 162.5. Actual months contain different numbers of workdays. Do not replace a specific workweek’s hours with this average to calculate overtime. Likewise, the IRS 130-hour monthly threshold belongs to its ACA framework, not to this 40 × 52 planning example.

What to check in a full-time offer

  1. Scheduled hours: identify start and end times, number of days and whether a meal period is unpaid.
  2. Workweek: ask when the fixed seven-day workweek begins; it may not match the calendar week or pay period.
  3. Classification and benefits: read the written criteria and effective dates for the particular plan rather than relying on the word “full-time” alone.
  4. Actual hours and pay: keep records of time worked. For a covered, nonexempt worker, review hours over 40 in each workweek and any applicable state protections. The overtime calculator gives a limited single-rate gross-pay estimate.

Does 9 to 5 equal 40 hours a week?

Five eight-hour spans total 40 elapsed hours. With a genuinely unpaid 30-minute meal period on each day, actual worked time is 37.5 hours. With no such deduction, it is 40 hours. Count the time actually worked and applicable paid breaks.

Does a full-time employee automatically earn overtime after eight hours in a day?

No universal federal daily overtime rule follows from full-time status. Under the FLSA baseline, covered, nonexempt workers generally receive overtime after 40 hours worked in a workweek. State rules can add daily requirements.

Can an employer call 30 hours full-time?
